The two did not speak as the elder Caperton picked up his brother's cellphone and hat and put them in their mother's car in the parking lot of the Newport Square Apartment Homes at 3780 Rebecca Lane. Keith Caperton walked back to his apartment without saying a word, thinking his younger brother would drive back to their mother's house a few miles away, the affidavit said.

Another person found Kevin Caperton's body in the parking lot the next day.

He bled to death internally because an artery in his neck ruptured while he was in the chokehold, according to the affidavit.

Colorado Springs police arrested Keith Caperton on suspicion of manslaughter, a lesser felony charge than first- or second-degree murder that means someone "recklessly" causes another person's death.


A man in town for a holiday family baptism died in a parking lot fight with his older brother, who apparently had no idea his chokehold would prove fatal, court documents show.

Kevin Caperton, 54, died sometime after being released from between his brother's legs - a vice grip meant only to last "until he calmed down," the elder Keith Caperton, 56, told police.

The younger Caperton stood up, and was last seen "awake, breathing and alive" and leaning against a car after the 2-to-3-minute scuffle, the older brother told investigators, according to an arrest affidavit.
